Pineglance – Terms and Conditions

These Terms and Conditions (hereinafter referred to as the “Terms”) govern the use of Pineglance services provided by Calpine Infrastructure and Tech Solutions Pvt. Ltd. (hereinafter referred to as “Pineglance”, “we”, “us”, or “our”). By accessing or using Pineglance, the User agrees to comply with and be bound by these Terms. Users are requested to carefully read these Terms before using Our Service.

Scope

These Terms apply to all users accessing or using Pineglance worldwide, including event organizers, photographers, businesses, customers, and visitors (hereinafter referred to as “the User”).

Our Service may contain integrations with third-party platforms including payment gateways, WhatsApp services, cloud hosting providers, analytics providers, or external applications. Pineglance shall not be responsible for the functionality, availability, or policies of such third-party services.

1. Eligibility

By using Pineglance, the User confirms that:

  • The User is legally capable of entering into binding agreements.
  • The User possesses authority to upload and manage content shared through the platform.
  • The User agrees to comply with all applicable laws and regulations.

If the User does not agree with these Terms, the User must discontinue use of Our Service immediately.

2. Services Provided

Pineglance provides AI-powered photo management and sharing services including but not limited to:

  • AI-based facial recognition and photo matching
  • Event photo gallery management
  • Selfie-based image identification
  • WhatsApp photo delivery
  • Cloud photo storage
  • Photo approval workflows
  • Event-based photo sharing and downloading
  • Analytics and reporting features

Pineglance reserves the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. User Accounts

Certain features may require account registration.

The User agrees to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Accept responsibility for all activities under the account
  • Notify Pineglance immediately regarding unauthorized access or security breaches

Pineglance reserves the right to suspend or terminate accounts containing false information, abusive activity, or violations of these Terms.

4. User Content and Responsibility

Users may upload photographs, selfies, videos, event galleries, captions, or other content through Pineglance.

By uploading content, the User confirms that:

  • The User owns the content or possesses all necessary rights and permissions.
  • Necessary consent has been obtained from individuals appearing in uploaded photographs where legally required.
  • Uploaded content does not violate intellectual property rights, privacy rights, or applicable laws.
  • Uploaded content does not contain unlawful, abusive, offensive, defamatory, harmful, or misleading material.

The User shall remain solely responsible for uploaded content.

Pineglance shall not be liable for any claims, disputes, or damages arising from User-uploaded content.

5. AI and Facial Recognition Services

Pineglance uses Artificial Intelligence technologies including facial recognition and automated image analysis to identify and deliver matching photographs.

By using Pineglance, the User explicitly consents to:

  • Processing of selfies and uploaded images
  • Facial recognition and automated image matching
  • AI-based identification and photo delivery

Users acknowledge that AI-generated results may not always be fully accurate.

Pineglance does not guarantee perfect identification, matching accuracy, or uninterrupted service performance.

6. Data Storage and Retention

Uploaded data, event galleries, selfies, and associated content may be stored according to the subscription plan purchased by the User.

Unless otherwise specified:

  • Data may be retained for a maximum period of 30 days.
  • Non-renewal or expiration of plans may result in automatic deletion of stored data.
  • Storage duration and retention limits depend on the active subscription plan.

Pineglance shall not be responsible for data loss resulting from plan expiration, deletion requests, technical failures, or non-renewal of services.

7. Payments and Subscription

Certain Pineglance services may require payment or subscription.

The User agrees that:

  • Pricing may change at any time without prior notice.
  • Applicable taxes may be charged additionally.
  • Subscription validity depends on the selected plan.
  • Failure to complete payment may result in suspension or limitation of services.

Unless otherwise specified, payments made are non-refundable.

8. Prohibited Activities

Users shall not:

  • Attempt unauthorized access to the platform
  • Reverse engineer or disrupt the Service
  • Upload malicious software or harmful code
  • Use the platform for unlawful purposes
  • Infringe intellectual property rights
  • Impersonate another individual or organization
  • Misuse facial recognition or personal data of others

Violation of these Terms may result in immediate suspension or termination of access.

9. Intellectual Property Rights

All platform-related intellectual property including:

  • Software
  • Branding
  • Logos
  • AI systems
  • Designs
  • Features
  • Website content

remain the exclusive property of Calpine Infrastructure and Tech Solutions Pvt. Ltd.

Users shall not reproduce, distribute, modify, copy, or commercially exploit any part of Pineglance without prior written permission.

10. Third-Party Services

Pineglance may rely on third-party services including:

  • WhatsApp integrations
  • Payment gateways
  • Cloud infrastructure providers
  • Analytics tools
  • Communication platforms

Pineglance shall not be responsible for interruptions, failures, or issues caused by such third-party services.

Users are responsible for complying with the terms and policies of such external providers.

11. Limitation of Liability

To the maximum extent permitted by law, Pineglance shall not be liable for:

  • Data loss
  • Service interruptions
  • AI recognition inaccuracies
  • Unauthorized access
  • Indirect or consequential damages
  • Business loss or revenue loss
  • Third-party service failures

Our Service is provided on an “as-is” and “as-available” basis without warranties of any kind.

12. Indemnification

The User agrees to indemnify and hold harmless Pineglance, its employees, directors, partners, and affiliates from any claims, damages, liabilities, losses, or legal expenses arising from:

  • Violation of these Terms
  • User-uploaded content
  • Unauthorized activities
  • Violation of applicable laws or third-party rights

13. Termination

Pineglance reserves the right to suspend or terminate User access without prior notice if:

  • These Terms are violated
  • Fraudulent or unlawful activities are detected
  • Platform misuse occurs
  • Payments remain overdue

Upon termination, User access and stored data may be deleted permanently.

14. Privacy

Use of Pineglance is also governed by the Pineglance Privacy Policy.

By using Our Service, the User agrees to the collection and processing of information as described in the Privacy Policy.

15. Modification of Terms

Pineglance may periodically update these Terms and Conditions.

Users shall be notified regarding significant changes through the website, application, email, or dashboard notifications.

Continued use of Pineglance after modifications constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising from these Terms or the use of Pineglance shall be subject to the jurisdiction of courts located in Ernakulam, Kerala.
